General Terms and ConditionsThese General Terms and Conditions (hereinafter "our GTC") exclusively govern the contractual relationship between Rawbet GmbH, Hersfelder Straße 21 - 23, 60487 Frankfurt am Main, Germany (hereinafter "Rawbet", "we" or "us") and users (hereinafter "players" or "you") who use the services offered by Rawbet via its website and/or mobile application (hereinafter "Rawbet services"). Our Terms and Conditions also apply to all content sent and uploaded by players through the Rawbet services.
1. Scope of services
1.1. Rawbet is a social gaming application. We enable console players to meet via the app and compete against certain stakes of money and other prizes in different game formats (e.g. duels, tournaments, leaderboards etc.) (hereinafter referred to as "Skill Games").1.2. Rawbet-Services are not available in areas with legal regulations that restrict the provision of skill gaming services for money or prizes. In order to ensure compliance with these rules, Rawbet is entitled to require players to provide proof of their current place of residence or to impose technical access restrictions1.3. Rawbet-Services are limited to a limited number of supported games. For more information on the games currently supported by the Rawbet services, please visit our website https://www.rawbetapp.com/. Rawbet is not obliged to maintain support for certain games and may decide to discontinue support for certain games at any time in its sole discretion.1.4. Rawbet does not guarantee continuous availability of the Rawbet-Services. Timeouts may occur especially in case of technical problems or during maintenance. Planned maintenance work will usually be communicated to registered players in advance.
2. Registration for Rawbet-Services
2.1. To register for Rawbet-Services, you must be of legal age. Rawbet reserves the right to request a valid proof of age as part of the registration process or at any time during the contract period, e.g. through third party providers or requesting a copy of an official ID.2.2. To use the Rawbet-Services you must first register a Rawbet account. The registration is done on our website and/or mobile application either via our Rawbet registration form (if available) or via your existing account with a Rawbet compatible streaming provider (e.g. Twitch). As part of the registration with a compatible streaming provider, simply enter your valid login data (hereinafter referred to as streaming-login) in the SignUp form on our website https://www.rawbetapp.com/ and/or within a Rawbet application. You also have the possibility to register first with a streaming provider using the registration form of a streaming provider embedded in a Rawbet-Service. In any case we will then automatically receive the information required for registration. In addition, we may request further information required for registration to create a Rawbet account.2.3. By entering your streaming-login or the required information in our registration form and clicking the button at the bottom of the registration form you are making a binding offer to open a Rawbet account. Once your request is approved by us, you will receive an email confirming the creation of your Rawbet account. Upon receipt of this email a contractual relationship will be established between Rawbet and the player for the provision of the Rawbet-Services, which is governed by these terms and conditions. By entering or participating in a Skill-Game a contractual relationship according to § 762 BGB (German Civil Code) is further established directly between the participating players, in which Rawbet is not included as a party to the contract.2.4. The login to your Rawbet account is done via the streaming-login or via the login data you selected during the registration of your Rawbet account. Setting up and operating multiple accounts for one person is prohibited. Rawbet accounts are not transferable.2.5. The player is obliged to keep his access data secret and not to pass them on to third parties. The player is responsible for any damage caused by disclosure of his access data to third parties.2.6. In order to ensure that Rawbet is able to fulfill its contractual and legal notification and information obligations to the player in a timely and complete manner, the player will inform Rawbet of any changes to his contact details without being asked and without delay. Most of these can be changed in the personal player account after login.2.7. In order to ensure the integrity of the Rawbet-Services, Rawbet is entitled at any time to require effective proof of identity from the player and to suspend the player's further participation in Rawbet-Services until such proof of identity is provided.
3. Conditions for participation in Skill-Games
3.1. Rawbet offers a platform where players can meet and challenge each other through the Rawbet website or a Rawbet application within Skill-Games. In order to participate in such Skill-Games the players themselves must ensure that they have the necessary equipment (e.g. compatible game consoles and games) to participate in the respective games. For more information about the technical equipment currently supported by Rawbet-Services, which may change from time to time, please visit our website https://www.rawbetapp.com/.3.2. Players must also have a working account with a streaming provider compatible with Rawbet services (as shown on our website) and must take all necessary steps to stream the games via the streaming account associated with their Rawbet account. Streaming of the game is a mandatory requirement for participation in Rawbet-Services.3.3. It is the sole responsibility of each player to ensure that their hardware, software and Internet connections are up-to-date, stable and meet the necessary system requirements.3.4. Rawbet has no control over the availability of the games and streaming services required to participate in Skill-Games and is not responsible for any disruption related to the games, the game play or the streaming services used when participating in the Rawbet-Services.
4. Participation in games
4.1. Participation in games takes place through the Rawbet application and (where available) through our website. Participation can take place in different ways. To participate in a Skill Game on the players own initiative, the player first selects a number of parameters, e.g. the game, the game platform and the desired stake. He then confirms by clicking on the correspondingly marked button that an opponent is to be sought and that he is interested in a duel or, depending on the selected parameters, in participating in a tournament or other Skill-Game. By selecting the button, the player bindingly declares that the Skill-Game is to take place with the selected parameters. The player will then be assigned one or more available opponent(s) based on Rawbet's matching algorithm, with whom the Skill-Game will be conducted. Alternatively the player can challenge a specific other player. In this case the player bindingly declares by selecting the button marked accordingly that he wants to invite or challenge another player and that the Skill-Game should take place with the selected parameters. A player can also participate in a Skill-Game by accepting the request of another player or by participating in a Skill-Game displayed to him. The relevant parameters for the Skill-Game result from the request or the displayed offer. By pressing the correspondingly marked button, the player makes a binding declaration that the Skill-Game is to take place with the offered parameters.4.2. The amounts that can be wagered by players in Skill-Games are limited to the amounts available in the Rawbet app at the time of using the Rawbet-Services. The amounts available may be changed by Rawbet at any time at their sole discretion.4.3. When participating in a Skill-Game, the amount wagered by players with a binding declaration of interest in participating in a Skill-Game is automatically deducted from both players' virtual Rawbet wallets and held in trust by Rawbet until the outcome of the game is determined.4.4. Once the outcome of the match has been determined, both players will still have the opportunity for a fixed period of time to enter into a complaint process if they believe that the score did not come about in accordance with the contractual requirements (for the complaint process, see section 12 below). If no complaint is received, the amount wagered by both players will be credited to the winning player's account, reduced by the fees payable under clause 9 of our Terms and Conditions. In the event of a draw, the amount wagered by each Player will be credited to the Player's accounts, reduced by the fees applicable under section 9 of our Terms and Conditions.4.5. With a binding declaration of interest in participating in a Skill-Game and the allocation of the opponent(s), the players are obliged to find themselves independently on the chosen game platform within the time period defined in the rules of conduct, to start the chosen game and to ensure that the game is streamed via the streaming channel linked to their own Rawbet account. All players are further obliged to play the Skill-Game until the end of the game according to the official rules of the chosen game and the Rawbet Rules of Conduct, which are linked on the Rawbet website and in the Rawbet application.
5. Rules of conduct
5.1. Players are obliged to abide by the rules of conduct set by Rawbet, which are linked on the Rawbet website and in the Rawbet application and may go beyond the following rules. The players must keep up to date with the current rules of conduct as they are subject to adjustments, e.g. to respond to player misconduct in the future.5.2. Players are in particular prohibited:5.2.1. provide incorrect, misleading, inaccurate or incomplete information to Rawbet in connection with their Rawbet account5.2.2. open multiple Rawbet accounts;5.2.3. within Skill-Games, not to abide by the rules applicable to the particular game or in any way to attempt to improperly influence the course of the game, especially by using mechanisms, software or other scripts that interfere with or may improperly influence the functioning of the game or the Rawbet-Services as intended by the Developer, for the benefit of the Player5.2.4. allow other persons to perform Skill-Games instead of the registered player;5.2.5. intentionally causing a disruption/failure to affect or prematurely terminate a game or stream;5.2.6. to gain an advantage by unfair behaviour of any kind, for example, deceiving other players or abusing a bug, contrary to the rules applicable to the game in question, thus jeopardising fair competition;5.2.7. engaging in any form of interaction with other members or other persons in such a way that an uninformed, uninitiated member is disadvantaged by this and thus has a reduced chance of fair play or winning;5.2.8. violate any other obligations and/or rights of others arising under any law, these Terms and Conditions and the Rules of the Game;5.2.9. take any action that may adversely affect the security and integrity of Rawbet-Services or other players' IT infrastructure;5.2.10. interfere in any way improperly with the payment processes within the Rawbet-Services;5.2.11. modify, adapt, sublicense, translate, commercially exploit, reverse engineer, decompile or disassemble any part of the Rawbet-Services;5.2.12. remove any copyright, trademark or other proprietary notices contained in or displayed on the Rawbet services or content used within the Rawbet-Services;5.2.13. to "frame" or "mirror" any part of the Rawbet-Services or link to any part of the Rawbet-Services without our prior written permission, except through the URL https://rawbetapp.com or the URLs we have provided to you for such purposes;5.2.14. use manual or automatic scripts or procedures to retrieve, index, "data mine" or in any way reproduce or circumvent the navigational structure or presentation of the Rawbet-Services.5.3. Rawbet-Services are offered based on the idea of fair play and basically the same conditions of participation for all players. Players are obliged to adhere to this principle.5.4. When using the Rawbet-Services, players may be able to contact and communicate with each other, e.g. if they want to challenge each other for a game. They are prohibited from exchanging content that5.4.1. contain advertising;5.4.2. are defamatory, degrading, libellous, terrorist, discriminatory or pornographic in nature;5.4.3. violate the rights of other players or third parties or constitute a criminal offence;5.4.4. contain viruses, computer programs or other malware that interfere with the functioning of other IT systems;5.4.5. serve the purpose of collecting, storing or using personal data of users without the respective express consent, in particular for business purposes;serve the purpose of poaching players from our services and transferring them to competing providers.6. Sanctions in case of misconduct
6.1. In the event of a breach of these terms and conditions and in particular the rules of conduct set out in section 5, Rawbet is entitled, depending on the severity of the breach and the player's previous behaviour, to temporarily block a player's Rawbet-Account and Rawbet-Wallet or to permanently terminate the user contract without notice and block the player from future registrations if further adherence to the user contract does not appear reasonable, taking into account the interests of the other players.6.2. Before blocking or terminating the Rawbet-Account, the player will usually be given the opportunity to comment on the allegations, unless immediate action is deemed necessary by way of exception to prevent further legal violations, to avert immediate danger or in the interest of the other players.6.3. If an infringement that could affect the game in any way, be it through offensive comments to another player, is discovered during the course of a skill game, Rawbet has the right to cancel any started Skill-Games completely or for the offending player and to evaluate them at the offending player's expense.6.4. If it is subsequently established that a player has influenced the outcome of a Skill Game in violation of these Terms and Conditions, Rawbet has the right to retroactively evaluate such Skill-Games at the expense of the offending player and deduct any winnings paid out to the offending player from the player's Rawbet-Wallet to be credited to the winning player. The right to assert a further claim for damages and the reclaim of winnings which exceed the current credit balance of the player in his Rawbet-Wallet is reserved.6.5. Rawbet is entitled to delete any content and statements that are in breach of the contract.6.6. The player indemnifies Rawbet from any claims of third parties, if such claims are made against Rawbet due to the player's behaviour contrary to the terms of the agreement. In such cases, the Player is obliged to fully indemnify Rawbet from third party claims and reimburse all costs of an appropriate legal defense.
7. Occurrence of problems
7.1. Rawbet is not liable for lost or potential winnings, including in the event of prematurely terminated games or tournaments or misconduct by other players.7.2. If a Skill-Game is abandoned before the end of the Skill-Game or if the Skill-Game cannot be scored for any other reason due to a technical fault attributable to Rawbet, both players will be refunded their stakes without deduction of any fees that may be incurred.7.3. If a player does not participate in a Skill-Game or does not ensure traceability of the game result through a stream in accordance with these Terms and Conditions or if a Skill-Game or the stream of a Skill-Game is aborted (hereinafter "Skill-Game Unavailability") and this can be attributed to a misconduct or technical error on the part of one of the participating players, the skill game will be evaluated for the other player and the winnings will be paid out accordingly.7.4. In the event of a Skill-Game not being valid, which cannot be clearly attributed to an error on the part of Rawbet or to misconduct or technical error on the part of any of the players, all players will be paid the stakes as in the case of a tie. The same applies if a Skill-Game is abandoned because the participating players are not identical to the players selected for that Skill-Game.
8. Rawbet-Wallet
8.1. In order to process bets and winnings, each player will be given a virtual money account ("Rawbet-Wallet") when a Rawbet-Account is opened. The account currency is EURO. Rawbet reserves the right to include other currencies in the future and there is no entitlement to offer or retain a particular currency. The currently available options for depositing amounts into the Rawbet-Wallet are shown on our website and/or in the Rawbet application. Rawbet has the right to credit the Rawbet-Wallet only after the deposit amount is irrevocably credited to Rawbet's deposit account. Deposits by bank transfer (where permitted) must be made stating the purpose of the payment as stated by Rawbet. Only after crediting the Rawbet-Wallet can the player participate in Skill-Games.8.2. Rawbet reserves the right to set minimum and/or maximum amounts for deposits on the Rawbet-Wallet. Rawbet further reserves the right to set maximum amounts for the total amounts credited to the Rawbet-Wallet, if these are exceeded Rawbet can make a payout of excess amounts to the player and block the Rawbet-Account until this payout is made. For the payout modalities the regulations according to clause 8.5 apply accordingly. These minimum and maximum amounts can also be set individually for individual players if Rawbet considers this necessary, e.g. due to the player's playing behaviour.8.3. Rawbet reserves the right to charge deposit fees for deposits to the Rawbet-Wallet according to the fee schedule published on our website and/or in the Rawbet application.8.4. Costs incurred by Rawbet due to payment reclaims (e.g. bank transfer returns, credit card returns) or increased bank charges for transfers from or to foreign countries (e.g. when withdrawing winnings or account balances) are to be borne by the player and may be debited to the Rawbet-Wallet or the amount to be withdrawn.8.5. Rawbet is not a banking institution and any money paid into the Rawbet-Wallet is not insured and/or does not bear interest. The Player is responsible for ensuring that all deposits come from a payment source for which the Player is the registered Account Holder. If deposits are made in a currency other than EURO, any conversion fees and bank charges will be borne by the Player.8.6. Players are entitled to withdraw their balance or any part of it at any time, as long as the amount to be withdrawn is at least the minimum withdrawal amount according to the fee schedule published on our website and/or in the Rawbet application. The above minimum withdrawal amount does not apply to withdrawals due to a Rawbet-Account closure. The requested withdrawal amount will be handled by Rawbet. Rawbet is entitled to pay part or all of a requested withdrawal using the same payment method and in the same currency in which the respective deposits were made. If this is not possible, Rawbet will ask the player to provide an alternative payment account and, if necessary, proof of identity within a reasonable time. If a player fails to provide a valid payment account and, if applicable, additional proof of identity within the reasonable time limit set, the withdrawal request will be deemed withdrawn.8.7. All fees incurred for the transfer of the amount withdrawn by the player will be borne by the player and deducted from the withdrawal. Withdrawals will be processed within 10 business days of receipt of the withdrawal request. Special credits deposited by Rawbet as part of marketing campaigns for use as a starting fee only are not eligible for withdrawal. 8.8. Rawbet is entitled to charge a withdrawal fee for each withdrawal and payout according to the fee schedule published on our website and/or in the Rawbet application.8.9. To prevent money laundering and other misconduct, Rawbet is entitled to withhold funds until a player provides proof of identity. 8.10. Rawbet is further entitled to block all or part of the funds on a player's Rawbet-Wallet if there are ongoing legal proceedings (see section 12) pending regarding the outcome of individual skill games.
9. Fee’s for participation in Skill-Games
9.1. Setting up and maintaining a Rawbet-Account is free of charge.9.2. Players must pay a participation fee for participation in Skill-Games. The current valid participation fee is published on our website https://www.rawbetapp.com/ and in the Rawbet app and we will inform the player before binding declaration of interest in participating in a Skill-Game.9.3. The participation fee is generally due as soon as a player has bindingly declared his interest in participating in a Skill-Game by clicking the corresponding button.9.4. The obligation to pay the fee does not apply if no suitable opponent can be assigned to the player or if the player cancels the process before an opponent is assigned.9.5. Rawbet is entitled to charge a cancellation fee for prematurely cancelled assignment processes according to the fee catalog published on our website and/or in the Rawbet application.
10. Contract period, revocation, termination, inactive accounts
10.1. The contract for setting up and using a Rawbet-Account in accordance with these terms and conditions ("contract of use") is generally concluded for an unlimited period.10.2. Information on the right of revocation can be found here [link to revocation policy].10.3. Both the player and Rawbet have the right to terminate the contract of use at any time without giving any reason by giving two weeks notice.10.4. The right to extraordinary termination for good cause remains unaffected. On the part of Rawbet, good cause is to be assumed in particular if a player violates the rules in section 5.1.2-5.1.9.10.5. If a player does not log into his Rawbet-Account for an uninterrupted period of 365 days, the account will be considered "inactive" after 365 days, which the player will be notified of via the deposited communication media. Inactive accounts can be terminated by Rawbet at any time without notice, but no earlier than two weeks after notification of the inactivity of the account to the player.10.6. In the event of termination, the funds contained in a player's Rawbet-Wallet will be paid out to the player. Rawbet has the right to pay the payout in part or in full using the same payment method and in the same currency as the respective deposits were made. If this is not possible, Rawbet will ask the player to provide an alternative payment account and, if necessary, proof of identity within a reasonable period of time. If a player fails to provide a valid payment account and, if applicable, additional proof of identity within the reasonable time limit set, a monthly account maintenance fee according to the fee schedule published on our website and/or in the Rawbet application will be charged starting the day after the end of the set time limit.10.7. Rawbet is entitled to charge a withdrawal fee according to the fees published on our website and/or in the Rawbet application.10.8. All fees incurred for the transfer of the amount to be withdrawn will be borne by the Player and deducted from the withdrawal. Withdrawals will be processed within 10 business days from the effective date of the cancellation. Special credits deposited by Rawbet as part of marketing campaigns for the sole purpose of using them as a starting fee are not eligible for withdrawal. 10.9. To prevent money laundering and other misconduct, Rawbet is entitled to withhold funds until a player provides proof of identity.11. Limitation of liability
11.1. Rawbet's liability for damages shall be governed by the following provisions.11.2.Unless otherwise specified below, Rawbet is only liable for its own behaviour or the behaviour of representatives and vicarious agents in cases of gross negligence or intent.11.3. Rawbet is also liable for damages resulting from injury to life, body or health if these were caused by its own simple negligent behaviour or simple negligent behaviour of a representative or vicarious agent. The same applies if an essential contractual obligation, i.e. an obligation whose fulfilment is essential for the proper execution of the contract and on whose compliance the contractual partner regularly relies and may rely, has been breached.11.4.Any liability of Rawbet under the Product Liability Act as well as any existing statutory warranty for defects shall remain unaffected by the above clauses.
12. Dispute settlement procedure
12.1.In the event that something goes wrong during the game or in case of other complaints, players have the opportunity to participate in a dispute resolution procedure.12.2. If, during a game, Players discover that something is not in accordance with these Terms and Conditions and/or the Rawbet Rules of Conduct, they have the opportunity to make a complaint during the game. In this case the game will be suspended and frozen and players will have the opportunity to resolve the complaint directly through a chat with our support team.12.3. After completion of a Skill-Game, players have the opportunity to object to the scoring of a game within the time period displayed in the Rawbet-Services ("Complaint Period"). In this case, the amount of money wagered will be frozen and players will have the opportunity to resolve the complaint directly via a chat with our support.12.4. If the error or breach can be located and attributed, the game will be scored and winnings paid out in accordance with these Terms and Conditions. If the facts of the case cannot be clarified, the provision in section 7.4 shall apply. 12.5. After expiry of the period for appeal, the evaluation will be carried out according to the result determined and the winnings will be paid out. After payment of the winnings, there is basically no right of appeal against the scoring.
13. Grant of rights
13.1. By participating in Skill-Games, the Player grants Rawbet permission to reproduce, publish and publicly display the stream of the Skill-Game and all information disclosed therein (communication, player names, if applicable, images of the players etc.) as well as content, the game results and stakes and other content provided by the Player as part of the Rawbet-Services (e.g. logos) (hereinafter referred to as "User Content") within the Rawbet-Services (including the right to make it publicly available for retrieval at any time). This also includes the right to use the User Content for advertising purposes within the Rawbet-Services.13.2. The player guarantees that he/she has the necessary rights for all user content that he/she brings in.13.3. The player waives the right to be named as the author in connection with the use of any copyrighted user content.
14. Severability clause, choice of law
14.1.If individual provisions of this contract are or become partially or completely invalid, the validity of the remaining contract shall remain unaffected. Such provisions shall be replaced by the remaining provisions, if possible by supplementary interpretation of the contract or otherwise by the parties by mutual agreement by such provisions which, taking into account the interests and the common need for regulation, are most likely to achieve the purpose of the contract in a legally effective form.14.2. The contract is subject to the law of the Federal Republic of Germany. This choice of law does not affect those provisions which may not be deviated from by agreement under the law of the country in which the player has his habitual residence.
15. Supplementary consumer infromation
15.1. We support English and German as contract languages. The text of the contract will not be stored by us after the conclusion of the contract and is not accessible to the player.15.2. Rawbet is neither legally obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board according to the CDBG.Status date: 21.July 2020

In order to participate in such Skill-Games the players themselves must ensure that they have the necessary equipment (e.g. compatible game consoles and games) to participate in the respective games. For more information about the technical equipment currently supported by Rawbet-Services, which may change from time to time, please visit our website https://www.rawbetapp.com/.3.2. Players must also have a working account with a streaming provider compatible with Rawbet services (as shown on our website) and must take all necessary steps to stream the games via the streaming account associated with their Rawbet account. Streaming of the game is a mandatory requirement for participation in Rawbet-Services.3.3. It is the sole responsibility of each player to ensure that their hardware, software and Internet connections are up-to-date, stable and meet the necessary system requirements.3.4. Rawbet has no control over the availability of the games and streaming services required to participate in Skill-Games and is not responsible for any disruption related to the games, the game play or the streaming services used when participating in the Rawbet-Services.
4. Participation in games
4.1. Participation in games takes place through the Rawbet application and (where available) through our website. Participation can take place in different ways. To participate in a Skill Game on the players own initiative, the player first selects a number of parameters, e.g. the game, the game platform and the desired stake. He then confirms by clicking on the correspondingly marked button that an opponent is to be sought and that he is interested in a duel or, depending on the selected parameters, in participating in a tournament or other Skill-Game. By selecting the button, the player bindingly declares that the Skill-Game is to take place with the selected parameters. The player will then be assigned one or more available opponent(s) based on Rawbet's matching algorithm, with whom the Skill-Game will be conducted. Alternatively the player can challenge a specific other player. In this case the player bindingly declares by selecting the button marked accordingly that he wants to invite or challenge another player and that the Skill-Game should take place with the selected parameters. A player can also participate in a Skill-Game by accepting the request of another player or by participating in a Skill-Game displayed to him. The relevant parameters for the Skill-Game result from the request or the displayed offer. By pressing the correspondingly marked button, the player makes a binding declaration that the Skill-Game is to take place with the offered parameters.4.2. The amounts that can be wagered by players in Skill-Games are limited to the amounts available in the Rawbet app at the time of using the Rawbet-Services. The amounts available may be changed by Rawbet at any time at their sole discretion.4.3. When participating in a Skill-Game, the amount wagered by players with a binding declaration of interest in participating in a Skill-Game is automatically deducted from both players' virtual Rawbet wallets and held in trust by Rawbet until the outcome of the game is determined.4.4. Once the outcome of the match has been determined, both players will still have the opportunity for a fixed period of time to enter into a complaint process if they believe that the score did not come about in accordance with the contractual requirements (for the complaint process, see section 12 below). If no complaint is received, the amount wagered by both players will be credited to the winning player's account, reduced by the fees payable under clause 9 of our Terms and Conditions. In the event of a draw, the amount wagered by each Player will be credited to the Player's accounts, reduced by the fees applicable under section 9 of our Terms and Conditions.4.5. With a binding declaration of interest in participating in a Skill-Game and the allocation of the opponent(s), the players are obliged to find themselves independently on the chosen game platform within the time period defined in the rules of conduct, to start the chosen game and to ensure that the game is streamed via the streaming channel linked to their own Rawbet account. All players are further obliged to play the Skill-Game until the end of the game according to the official rules of the chosen game and the Rawbet Rules of Conduct, which are linked on the Rawbet website and in the Rawbet application.
5. Rules of conduct
5.1. Players are obliged to abide by the rules of conduct set by Rawbet, which are linked on the Rawbet website and in the Rawbet application and may go beyond the following rules. The players must keep up to date with the current rules of conduct as they are subject to adjustments, e.g. to respond to player misconduct in the future.5.2. Players are in particular prohibited:5.2.1. provide incorrect, misleading, inaccurate or incomplete information to Rawbet in connection with their Rawbet account5.2.2. open multiple Rawbet accounts;5.2.3. within Skill-Games, not to abide by the rules applicable to the particular game or in any way to attempt to improperly influence the course of the game, especially by using mechanisms, software or other scripts that interfere with or may improperly influence the functioning of the game or the Rawbet-Services as intended by the Developer, for the benefit of the Player5.2.4. allow other persons to perform Skill-Games instead of the registered player;5.2.5. intentionally causing a disruption/failure to affect or prematurely terminate a game or stream;5.2.6. to gain an advantage by unfair behaviour of any kind, for example, deceiving other players or abusing a bug, contrary to the rules applicable to the game in question, thus jeopardising fair competition;5.2.7. engaging in any form of interaction with other members or other persons in such a way that an uninformed, uninitiated member is disadvantaged by this and thus has a reduced chance of fair play or winning;5.2.8. violate any other obligations and/or rights of others arising under any law, these Terms and Conditions and the Rules of the Game;5.2.9. take any action that may adversely affect the security and integrity of Rawbet-Services or other players' IT infrastructure;5.2.10. interfere in any way improperly with the payment processes within the Rawbet-Services;5.2.11. modify, adapt, sublicense, translate, commercially exploit, reverse engineer, decompile or disassemble any part of the Rawbet-Services;5.2.12. remove any copyright, trademark or other proprietary notices contained in or displayed on the Rawbet services or content used within the Rawbet-Services;5.2.13. to "frame" or "mirror" any part of the Rawbet-Services or link to any part of the Rawbet-Services without our prior written permission, except through the URL https://rawbetapp.com or the URLs we have provided to you for such purposes;5.2.14. use manual or automatic scripts or procedures to retrieve, index, "data mine" or in any way reproduce or circumvent the navigational structure or presentation of the Rawbet-Services.5.3. Rawbet-Services are offered based on the idea of fair play and basically the same conditions of participation for all players. Players are obliged to adhere to this principle.5.4. When using the Rawbet-Services, players may be able to contact and communicate with each other, e.g. if they want to challenge each other for a game. They are prohibited from exchanging content that5.4.1. contain advertising;5.4.2. are defamatory, degrading, libellous, terrorist, discriminatory or pornographic in nature;5.4.3. violate the rights of other players or third parties or constitute a criminal offence;5.4.4. contain viruses, computer programs or other malware that interfere with the functioning of other IT systems;5.4.5. serve the purpose of collecting, storing or using personal data of users without the respective express consent, in particular for business purposes;serve the purpose of poaching players from our services and transferring them to competing providers.6. Sanctions in case of misconduct
6.1. In the event of a breach of these terms and conditions and in particular the rules of conduct set out in section 5, Rawbet is entitled, depending on the severity of the breach and the player's previous behaviour, to temporarily block a player's Rawbet-Account and Rawbet-Wallet or to permanently terminate the user contract without notice and block the player from future registrations if further adherence to the user contract does not appear reasonable, taking into account the interests of the other players.6.2. Before blocking or terminating the Rawbet-Account, the player will usually be given the opportunity to comment on the allegations, unless immediate action is deemed necessary by way of exception to prevent further legal violations, to avert immediate danger or in the interest of the other players.6.3. If an infringement that could affect the game in any way, be it through offensive comments to another player, is discovered during the course of a skill game, Rawbet has the right to cancel any started Skill-Games completely or for the offending player and to evaluate them at the offending player's expense.6.4. If it is subsequently established that a player has influenced the outcome of a Skill Game in violation of these Terms and Conditions, Rawbet has the right to retroactively evaluate such Skill-Games at the expense of the offending player and deduct any winnings paid out to the offending player from the player's Rawbet-Wallet to be credited to the winning player. The right to assert a further claim for damages and the reclaim of winnings which exceed the current credit balance of the player in his Rawbet-Wallet is reserved.6.5. Rawbet is entitled to delete any content and statements that are in breach of the contract.6.6. The player indemnifies Rawbet from any claims of third parties, if such claims are made against Rawbet due to the player's behaviour contrary to the terms of the agreement. In such cases, the Player is obliged to fully indemnify Rawbet from third party claims and reimburse all costs of an appropriate legal defense.
7. Occurrence of problems
7.1. Rawbet is not liable for lost or potential winnings, including in the event of prematurely terminated games or tournaments or misconduct by other players.7.2. If a Skill-Game is abandoned before the end of the Skill-Game or if the Skill-Game cannot be scored for any other reason due to a technical fault attributable to Rawbet, both players will be refunded their stakes without deduction of any fees that may be incurred.7.3. If a player does not participate in a Skill-Game or does not ensure traceability of the game result through a stream in accordance with these Terms and Conditions or if a Skill-Game or the stream of a Skill-Game is aborted (hereinafter "Skill-Game Unavailability") and this can be attributed to a misconduct or technical error on the part of one of the participating players, the skill game will be evaluated for the other player and the winnings will be paid out accordingly.7.4. In the event of a Skill-Game not being valid, which cannot be clearly attributed to an error on the part of Rawbet or to misconduct or technical error on the part of any of the players, all players will be paid the stakes as in the case of a tie. The same applies if a Skill-Game is abandoned because the participating players are not identical to the players selected for that Skill-Game.
8. Rawbet-Wallet
8.1. In order to process bets and winnings, each player will be given a virtual money account ("Rawbet-Wallet") when a Rawbet-Account is opened. The account currency is EURO. Rawbet reserves the right to include other currencies in the future and there is no entitlement to offer or retain a particular currency. The currently available options for depositing amounts into the Rawbet-Wallet are shown on our website and/or in the Rawbet application. Rawbet has the right to credit the Rawbet-Wallet only after the deposit amount is irrevocably credited to Rawbet's deposit account. Deposits by bank transfer (where permitted) must be made stating the purpose of the payment as stated by Rawbet. Only after crediting the Rawbet-Wallet can the player participate in Skill-Games.8.2. Rawbet reserves the right to set minimum and/or maximum amounts for deposits on the Rawbet-Wallet. Rawbet further reserves the right to set maximum amounts for the total amounts credited to the Rawbet-Wallet, if these are exceeded Rawbet can make a payout of excess amounts to the player and block the Rawbet-Account until this payout is made. For the payout modalities the regulations according to clause 8.5 apply accordingly. These minimum and maximum amounts can also be set individually for individual players if Rawbet considers this necessary, e.g. due to the player's playing behaviour.8.3. Rawbet reserves the right to charge deposit fees for deposits to the Rawbet-Wallet according to the fee schedule published on our website and/or in the Rawbet application.8.4. Costs incurred by Rawbet due to payment reclaims (e.g. bank transfer returns, credit card returns) or increased bank charges for transfers from or to foreign countries (e.g. when withdrawing winnings or account balances) are to be borne by the player and may be debited to the Rawbet-Wallet or the amount to be withdrawn.8.5. Rawbet is not a banking institution and any money paid into the Rawbet-Wallet is not insured and/or does not bear interest. The Player is responsible for ensuring that all deposits come from a payment source for which the Player is the registered Account Holder. If deposits are made in a currency other than EURO, any conversion fees and bank charges will be borne by the Player.8.6. Players are entitled to withdraw their balance or any part of it at any time, as long as the amount to be withdrawn is at least the minimum withdrawal amount according to the fee schedule published on our website and/or in the Rawbet application. The above minimum withdrawal amount does not apply to withdrawals due to a Rawbet-Account closure. The requested withdrawal amount will be handled by Rawbet. Rawbet is entitled to pay part or all of a requested withdrawal using the same payment method and in the same currency in which the respective deposits were made. If this is not possible, Rawbet will ask the player to provide an alternative payment account and, if necessary, proof of identity within a reasonable time. If a player fails to provide a valid payment account and, if applicable, additional proof of identity within the reasonable time limit set, the withdrawal request will be deemed withdrawn.8.7. All fees incurred for the transfer of the amount withdrawn by the player will be borne by the player and deducted from the withdrawal. Withdrawals will be processed within 10 business days of receipt of the withdrawal request. Special credits deposited by Rawbet as part of marketing campaigns for use as a starting fee only are not eligible for withdrawal. 8.8. Rawbet is entitled to charge a withdrawal fee for each withdrawal and payout according to the fee schedule published on our website and/or in the Rawbet application.8.9. To prevent money laundering and other misconduct, Rawbet is entitled to withhold funds until a player provides proof of identity. 8.10. Rawbet is further entitled to block all or part of the funds on a player's Rawbet-Wallet if there are ongoing legal proceedings (see section 12) pending regarding the outcome of individual skill games.
9. Fee’s for participation in Skill-Games
9.1. Setting up and maintaining a Rawbet-Account is free of charge.9.2. Players must pay a participation fee for participation in Skill-Games. The current valid participation fee is published on our website https://www.rawbetapp.com/ and in the Rawbet app and we will inform the player before binding declaration of interest in participating in a Skill-Game.9.3. The participation fee is generally due as soon as a player has bindingly declared his interest in participating in a Skill-Game by clicking the corresponding button.9.4. The obligation to pay the fee does not apply if no suitable opponent can be assigned to the player or if the player cancels the process before an opponent is assigned.9.5. Rawbet is entitled to charge a cancellation fee for prematurely cancelled assignment processes according to the fee catalog published on our website and/or in the Rawbet application.
10. Contract period, revocation, termination, inactive accounts
10.1. The contract for setting up and using a Rawbet-Account in accordance with these terms and conditions ("contract of use") is generally concluded for an unlimited period.10.2. Information on the right of revocation can be found here [link to revocation policy].10.3. Both the player and Rawbet have the right to terminate the contract of use at any time without giving any reason by giving two weeks notice.10.4. The right to extraordinary termination for good cause remains unaffected. On the part of Rawbet, good cause is to be assumed in particular if a player violates the rules in section 5.1.2-5.1.9.10.5. If a player does not log into his Rawbet-Account for an uninterrupted period of 365 days, the account will be considered "inactive" after 365 days, which the player will be notified of via the deposited communication media. Inactive accounts can be terminated by Rawbet at any time without notice, but no earlier than two weeks after notification of the inactivity of the account to the player.10.6. In the event of termination, the funds contained in a player's Rawbet-Wallet will be paid out to the player. Rawbet has the right to pay the payout in part or in full using the same payment method and in the same currency as the respective deposits were made. If this is not possible, Rawbet will ask the player to provide an alternative payment account and, if necessary, proof of identity within a reasonable period of time. If a player fails to provide a valid payment account and, if applicable, additional proof of identity within the reasonable time limit set, a monthly account maintenance fee according to the fee schedule published on our website and/or in the Rawbet application will be charged starting the day after the end of the set time limit.10.7. Rawbet is entitled to charge a withdrawal fee according to the fees published on our website and/or in the Rawbet application.10.8. All fees incurred for the transfer of the amount to be withdrawn will be borne by the Player and deducted from the withdrawal. Withdrawals will be processed within 10 business days from the effective date of the cancellation. Special credits deposited by Rawbet as part of marketing campaigns for the sole purpose of using them as a starting fee are not eligible for withdrawal. 10.9. To prevent money laundering and other misconduct, Rawbet is entitled to withhold funds until a player provides proof of identity.11. Limitation of liability
11.1. Rawbet's liability for damages shall be governed by the following provisions.11.2.Unless otherwise specified below, Rawbet is only liable for its own behaviour or the behaviour of representatives and vicarious agents in cases of gross negligence or intent.11.3. Rawbet is also liable for damages resulting from injury to life, body or health if these were caused by its own simple negligent behaviour or simple negligent behaviour of a representative or vicarious agent. The same applies if an essential contractual obligation, i.e. an obligation whose fulfilment is essential for the proper execution of the contract and on whose compliance the contractual partner regularly relies and may rely, has been breached.11.4.Any liability of Rawbet under the Product Liability Act as well as any existing statutory warranty for defects shall remain unaffected by the above clauses.
12. Dispute settlement procedure
12.1.In the event that something goes wrong during the game or in case of other complaints, players have the opportunity to participate in a dispute resolution procedure.12.2. If, during a game, Players discover that something is not in accordance with these Terms and Conditions and/or the Rawbet Rules of Conduct, they have the opportunity to make a complaint during the game. In this case the game will be suspended and frozen and players will have the opportunity to resolve the complaint directly through a chat with our support team.12.3. After completion of a Skill-Game, players have the opportunity to object to the scoring of a game within the time period displayed in the Rawbet-Services ("Complaint Period"). In this case, the amount of money wagered will be frozen and players will have the opportunity to resolve the complaint directly via a chat with our support.12.4. If the error or breach can be located and attributed, the game will be scored and winnings paid out in accordance with these Terms and Conditions. If the facts of the case cannot be clarified, the provision in section 7.4 shall apply. 12.5. After expiry of the period for appeal, the evaluation will be carried out according to the result determined and the winnings will be paid out. After payment of the winnings, there is basically no right of appeal against the scoring.
13. Grant of rights
13.1. By participating in Skill-Games, the Player grants Rawbet permission to reproduce, publish and publicly display the stream of the Skill-Game and all information disclosed therein (communication, player names, if applicable, images of the players etc.) as well as content, the game results and stakes and other content provided by the Player as part of the Rawbet-Services (e.g. logos) (hereinafter referred to as "User Content") within the Rawbet-Services (including the right to make it publicly available for retrieval at any time). This also includes the right to use the User Content for advertising purposes within the Rawbet-Services.13.2. The player guarantees that he/she has the necessary rights for all user content that he/she brings in.13.3. The player waives the right to be named as the author in connection with the use of any copyrighted user content.
14. Severability clause, choice of law
14.1.If individual provisions of this contract are or become partially or completely invalid, the validity of the remaining contract shall remain unaffected. Such provisions shall be replaced by the remaining provisions, if possible by supplementary interpretation of the contract or otherwise by the parties by mutual agreement by such provisions which, taking into account the interests and the common need for regulation, are most likely to achieve the purpose of the contract in a legally effective form.14.2. The contract is subject to the law of the Federal Republic of Germany. This choice of law does not affect those provisions which may not be deviated from by agreement under the law of the country in which the player has his habitual residence.
15. Supplementary consumer infromation
15.1. We support English and German as contract languages. The text of the contract will not be stored by us after the conclusion of the contract and is not accessible to the player.15.2.
